DMCA Takedown Policy
DMCA Takedown Policy
Last updated: September 2026
1. Introduction
PreFancy Inc. ("PreFancy", "we", "us" or "our") owns and operates the website www.prefancy.com (the "Site"). This DMCA Takedown Policy explains how to report content published on the Site that you believe infringes your copyright, and how users can respond if their content is removed.
This policy applies only to content published on prefancy.com. If you need help with infringing material found on other websites, please contact us through our Contact page.
2. Our Commitment to Copyright
We respect the intellectual property rights of creators and copyright owners, and we expect our users to do the same. PreFancy complies with the notice-and-takedown provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"). We act as a "service provider" within the meaning of 17 U.S.C. § 512(k)(1) and have adopted the procedures below for handling claims of copyright infringement by our creators, fans and other users.
3. Notice of Claimed Infringement
If you believe that your work has been copied and published on PreFancy in a way that constitutes copyright infringement, please send our Designated Copyright Agent (see Section 4) a written notice (a "Notice") that includes all of the following:
a physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
a description of the copyrighted work that you claim has been infringed (or, if several works are covered by one Notice, a representative list of those works);
a description of where the allegedly infringing material is located on the Site, including the specific URL(s) of the post, profile, message or other content wherever possible;
your full name, postal address, telephone number and email address;
a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law; and
a statement, made under penalty of perjury, that the information in your Notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf.
Notices that do not include all of the information above may not be processed.
4. Our Designated Copyright Agent
Please send your Notice or Counter-Notification to:
DMCA Agent – PreFancy Inc.
Email: [email protected] (subject line: "DMCA Notice" or "DMCA Counter-Notification")
Phone: +1 (548) 870-5743
Please send only DMCA Notices and Counter-Notifications to this contact using the subject lines above. Other questions, such as account, payment, subscription or cancellation requests, will not be handled under this policy and should be sent through our Contact page. Unless we have given prior express permission, our DMCA Agent is not authorised to accept or waive service of formal legal process.
More information about DMCA notice requirements is available here: 17 U.S.C. § 512.
5. Misuse of the DMCA Process
Submitting a false Notice or Counter-Notification, or knowingly misrepresenting that material or activity is infringing (or was removed by mistake), may make you liable for damages, including court costs and attorneys' fees, under 17 U.S.C. § 512(f). This procedure applies only to claims of copyright infringement by copyright owners and their authorised agents. It does not cover other types of complaints, such as trademark, privacy, impersonation or abusive content. Those can be reported using the report feature on the Site or through our Contact page. We will investigate and take action against anyone who abuses the Notice or Counter-Notification process. Please make sure you meet all legal requirements before submitting a Notice.
6. Takedown Procedure
When we receive a Notice of claimed copyright infringement, we follow this procedure:
We may, at any time, remove or disable access to any material on the Site that is claimed to be infringing, or that we believe is infringing based on facts or circumstances that make the infringement apparent.
If a Notice does not fully comply with the DMCA but substantially identifies the copyrighted work, the allegedly infringing material and the complaining party's contact details, we will make reasonable efforts to contact the complaining party to help them complete the Notice.
When we receive a valid Notice, we will act promptly to remove or disable access to the material identified, and we will notify the user who posted it.
The affected user may then submit a Counter-Notification as described in Section 7.
7. Counter-Notification Procedure
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a Counter-Notification under Sections 512(g)(2) and (3) of the DMCA. A Counter-Notification is the proper way to dispute the removal of material following a Notice. The information you provide must be accurate and truthful, and you will be liable for any misrepresentation that leads to claims against PreFancy relating to actions taken in response to your Counter-Notification.
To submit a Counter-Notification, please send our DMCA Agent a written communication that includes all of the following:
your physical or electronic signature;
a description of the material that was removed or disabled, and where it appeared on the Site before it was removed (including the specific URL(s) wherever possible);
a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. You may use the following wording:
"I swear, under penalty of perjury, that I have a good faith belief that the referenced material was removed or disabled by the service provider as a result of mistake or misidentification of the material to be removed or disabled."
your full name, postal address, telephone number and email address; and
a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which PreFancy may be found, and that you will accept service of process from the person who submitted the original Notice or their agent.
8. What Happens After a Counter-Notification
When we receive a valid Counter-Notification, we will forward a copy of it to the person who submitted the original Notice. Unless our DMCA Agent receives notice within ten (10) to fourteen (14) business days that the original claimant has filed a court action seeking to restrain the user from engaging in infringing activity relating to the material on the Site, we will restore the removed material or stop disabling access to it.
9. Language
All Notices and Counter-Notifications must be written in English. Notices or Counter-Notifications written in other languages may be treated as non-compliant and may not be processed.
10. Repeat Infringers
It is our policy to suspend or terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others. Any earnings connected with infringing content may be withheld in accordance with our Terms of Use.
11. Changes to This Policy
We may update, change or add to this policy at any time. The "Last updated" date at the top shows when it was last revised. Please check this page regularly to stay informed of any changes.
