Privacy Policy
1. Introduction
PreFancy Inc. ("we", "us", "our") respects your privacy and is committed to protecting the Personal Data we process about you. PreFancy Inc. owns and operates www.prefancy.com ("PreFancy"), a social network and content-sharing platform that allows (i) "Creators" to share and earn money from their own content (and to subscribe to and view the content of other Creators); and (ii) "Fans" to subscribe to and view the content of Creators.
This privacy policy ("Policy") explains how we handle Personal Data about our Creators and Fans, about people who appear in content uploaded by a Creator ("Content Collaborators"), and about people we deal with in our business relationships.
We process your Personal Data when you use PreFancy and the services we offer through it (the "Services"). We are the "data controller" of this Personal Data, which means we decide why and how it is processed.
If you have any questions about this Policy, please see Section 18 (Contact us).
2. What is Personal Data?
"Personal Data" means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, to a particular person or household.
We may also collect information that cannot identify you, such as de-identified, aggregated or anonymised data. This is not Personal Data, and this Policy does not apply to it.
3. Keeping your information up to date
Please keep the Personal Data we hold about you accurate and current. You can update or correct most of it at any time in your account settings on PreFancy.
4. Who this Policy applies to (18+ only)
This Policy is provided in addition to, but does not form part of, our Terms of Use, which govern your use of PreFancy and the Services.
The Services are strictly for people aged 18 or over. Anyone under 18 is not allowed to use the Services. By using the Services, you confirm that you are at least 18 years old. If we learn that we hold Personal Data about someone under 18, we will delete it and close the account.
5. Third-party links and services
PreFancy may contain links to third-party websites, plug-ins and apps (for example, links in Creator profiles, or connected services such as Spotify). Clicking those links or enabling those connections may allow third parties to collect or share Personal Data about you. We are not responsible for their content, security or privacy practices, and this Policy does not apply to them. Please read their own privacy and cookie policies.
6. If you do not want to provide Personal Data
We need certain Personal Data to give you access to the Services, or to specific features, under our contract with you (our Terms of Use). We are also required by law to process some Personal Data. If you choose not to provide Personal Data when we ask for it, we may not be able to give you access to the Services or to certain features.
7. Changes to this Policy
We may update this Policy from time to time. Updates take effect when we publish the revised Policy on PreFancy. If we make significant changes, we will make reasonable efforts to let you know, for example by a notification in your account or by email.
8. Categories of Personal Data we collect
We, or our service providers on our behalf, process the following kinds of Personal Data:
Account Data (Creators and Fans)
name, username and email address;
password (stored in encrypted, hashed form);
profile details you choose to add, such as avatar, cover image, bio, location, website and social media links, birthdate, gender and pronouns;
your subscriptions, subscribers, followers, lists, bookmarks and referrals;
posts, stories, reels, livestreams, comments, likes and polls you create;
chat messages between you and other users;
account and notification settings, including two-factor authentication settings;
support requests and messages you send us through the contact form or by email.
Verification Data (Creators and Content Collaborators)
full legal name and country of residence;
a copy of the government-issued identity document you provide;
a photo ("selfie") of you, which may include you holding your ID document;
release forms, including signatures, where you appear in another Creator's content;
the result of our age and identity check (approved, rejected and the reason).
We may also ask Fans to verify their age where this is required by law in their location. Where we use a third-party age or identity verification provider, that provider may collect this information directly and send us only the result.
Financial Data
Creators: payout details (such as bank account details, PayPal email or other payout method), payout country, billing details, tax information required by law, and business details if you operate as a company;
Creators and Fans: billing name and address, and funds added to your PreFancy wallet.
Card payments are processed by our third-party payment providers (such as Stripe, PayPal or other providers shown at checkout). We do not receive or store your full card number, expiry date or security code. The payment provider may share with us limited details such as a payment token, card type and the last four digits of your card.
Transaction Data
Creators: earnings, payments received, payout (withdrawal) requests, fees, and any failed payments;
Fans: subscriptions, unlocked posts and messages, tips, wallet top-ups, blue tick purchases and any failed payments.
Technical Data (Creators and Fans)
IP address and approximate country;
browser type, device type and user agent;
login times and last activity time;
push notification subscription tokens, if you enable browser notifications.
Usage Data and Cookies (Creators and Fans)
We use cookies and similar technologies that are necessary to run PreFancy, for example to keep you logged in, protect your account and remember your preferences (such as light/dark theme, language and age confirmation). We also use a cookie to recognise referral links so that Referring Users can be credited under our referral program.
We do not sell your Personal Data, and we do not share it for cross-site targeted advertising.
Third-party sign-in data
If you choose to sign in with Google, Facebook or X, we receive basic information from that provider, such as your name, email address and a unique account identifier. We do not receive your password for those services.
9. How we verify age and identity
Creators. Before you can earn money on PreFancy, we check that you are at least 18 and verify your identity. We will:
ask for your Verification Data, as described in Section 8;
check your country of residence, to make sure access to PreFancy is lawful;
ask for payout details, so that we can pay your earnings and help prevent fraud;
review your ID document and photo, either through our trained team or a third-party verification provider; and
check that you have not previously been banned from PreFancy.
Content Collaborators. Before you can appear in content uploaded by a Creator, you may need to complete age and identity verification and sign a release form.
Fans. All Fans must be at least 18. Depending on your location or the circumstances (for example, if we detect suspicious activity), we may ask you to complete an age check before you can access certain content.
If a third-party provider uses face-matching technology to compare your photo with your ID document, this is done by the provider on our behalf and only with your consent. We receive only the result of the check.
10. How and why we use your Personal Data
We process Personal Data on one or more of the following legal bases:
Performance of a contract: to provide the Services under our Terms of Use, for example to create your account, host Creator content, process payments and pay Creator earnings.
Consent: in specific cases, such as optional cookies, push notifications, or face-matching by a verification provider. You can withdraw your consent at any time.
Legitimate interests: where processing is necessary for our or a third party's legitimate interests, for example to keep PreFancy safe, prevent fraud and improve the Services.
Legal obligations: to comply with the law, for example tax and financial record-keeping, or responding to lawful requests from authorities.
Public interest: for example, reporting illegal activity to law enforcement or child-protection organisations.
We use your Personal Data to:
create and manage your account;
verify the age and identity of Creators, Content Collaborators and, where required, Fans;
provide the Services, including hosting content, processing subscriptions, unlocks, tips, wallet top-ups and blue tick purchases, and paying Creator earnings;
run our referral program;
provide support and communicate with you about your account and the Services, including changes to our Terms or this Policy;
send you notifications you have chosen to receive, such as new subscribers, messages, tips or new posts;
show you relevant creators and posts, for example on the homepage, in suggestions and in search;
moderate content, livestreams and messages, investigate breaches of our Terms, and remove illegal or prohibited content;
keep a record of banned users to prevent them from returning;
detect and prevent fraud, abuse, security incidents and illegal activity;
report illegal activity to, and respond to lawful requests from, law enforcement and other authorities;
comply with legal, tax and regulatory requirements;
maintain, test and improve PreFancy's performance, safety and features;
protect the rights and property of our users, ourselves and others; and
in connection with any possible sale, merger or reorganisation of our business.
If you use optional AI-powered features (such as caption or content suggestions), the text you submit may be sent to our AI service providers to generate a response.
We only use your Personal Data for the purposes for which we collected it, unless we reasonably decide that another purpose is compatible with the original one.
11. Where we get your Personal Data
Directly from you: when you create an account, complete verification, update your profile, upload content, make payments or contact us.
Automatically: through your use of the Services, for example Technical Data and Transaction Data.
From third parties: such as sign-in providers (Google, Facebook, X), payment providers, and age and identity verification providers.
12. Who we share your Personal Data with
Other users: your public profile (name, username, avatar, cover, bio and public posts) is visible to others. Content you share with subscribers, and messages you send, are visible to the people you share them with.
Service providers: companies that help us run PreFancy, such as hosting and cloud storage, payment processing, email and notification delivery, customer support, content moderation, AI features, and age and identity verification. They may only use your data to provide services to us.
Professional advisers: such as lawyers, accountants, auditors, bankers and insurers.
Corporate transactions: relevant parties in the event of a possible sale, merger, acquisition or reorganisation of our business.
Authorities and safety organisations: law enforcement, tax authorities, regulators and organisations such as the National Center for Missing & Exploited Children (NCMEC), where required by law, to protect the safety of our users and others, or to report illegal content.
13. International data transfers
Our service providers may process your Personal Data in countries other than the one where you live. Where required, we protect such transfers with appropriate safeguards, such as standard contractual clauses, or rely on other mechanisms permitted by applicable law. Contact us if you would like more information.
14. Your rights
Depending on where you live, and subject to certain exceptions, you may have the right to:
withdraw your consent at any time (this does not affect processing carried out before you withdrew it);
access the Personal Data we hold about you and receive a copy of it;
correct inaccurate or incomplete Personal Data;
delete your Personal Data where there is no legitimate reason for us to keep it (we may not be able to delete some data for legal reasons, for example if your account was closed for breaching our Terms);
restrict the processing of your Personal Data in certain circumstances;
transfer certain Personal Data to another party (data portability); and
object to processing based on our legitimate interests.
We do not make decisions about you based solely on automated processing that have legal or similarly significant effects on you.
You also have the right to complain to your local data protection authority. We would, however, appreciate the chance to address your concerns first, so please contact us.
We will not discriminate or retaliate against you for exercising your privacy rights.
15. How to exercise your rights
To exercise any of your rights, contact us using the details in Section 18. Please include enough information for us to confirm your identity and understand your request. We may ask for additional information to verify your identity, and may decline a request if we cannot verify it. If someone makes a request on your behalf, we will need proof that they are authorised to do so.
16. Your choices
Account settings: you can update your profile, privacy, notification and security settings at any time in your PreFancy settings.
Account deletion: you can delete your account from your settings, or ask us to do so.
Device permissions: you can control access to features such as notifications, camera and microphone through your browser or device settings.
Email notifications: we do not currently send marketing emails. We do send account-related emails (for example, new subscribers, tips, messages or renewals). You can switch off most of these in your notification settings. Some emails, such as account verification, security, payment and legal notices, cannot be switched off because they are necessary to provide the Services.
17. How long we keep your Personal Data
We keep Personal Data only for as long as reasonably necessary for the purposes described in this Policy. In general:
Providing the Services: for as long as your account is active, or as long as needed to provide the relevant feature.
Trust and safety: if you have (or we reasonably suspect you have) breached our Terms, or where we need to identify and report illegal activity, we keep the relevant data for as long as needed to investigate, assist authorities and prevent banned users from returning.
Legal and tax obligations: for example, identity verification and financial records, which may need to be kept for up to 7 years, or longer if required by a valid legal request.
Legal claims: for the applicable limitation period, or longer if needed to defend a claim.
When Personal Data is no longer needed, we delete it or anonymise it.

19. Additional information for U.S. residents
This section applies to residents of U.S. states with consumer privacy laws, such as California, Colorado, Connecticut, Virginia and Nevada.
No sale or targeted advertising: we do not sell Personal Data, and we do not share it for cross-context behavioural or targeted advertising. Nevada residents may still send us an opt-out request using the details in Section 18.
Sensitive information: some data we collect may be considered "sensitive" under certain laws, such as account login details, government ID numbers and images, partial payment card information and, where used by a verification provider with your consent, biometric data. We use it only to provide the Services, verify age and identity, prevent fraud, keep users safe and comply with the law, and we do not sell or share it for advertising.
Categories collected: identifiers (such as name, email, username and IP address); customer records (such as payment and payout details); characteristics (such as age and gender, if provided); commercial information (such as purchases and subscriptions); internet activity (such as device and log data); audio and visual information (such as photos and videos you upload and ID images); and inferences drawn from your use of the Services. We collect these from the sources in Section 11, for the purposes in Section 10, and share them with the recipients in Section 12.
De-identified information: where we hold de-identified data, we will not try to re-identify it, except as permitted by law.
Referral program: our referral program allows existing users to invite new users with a unique link and earn rewards as described in our Terms. Personal Data processed for the program is handled under this Policy. We consider the value of the program to be reasonably related to the value of the data processed for it.
Appeals: if we decline your privacy request, you may appeal by contacting us using the details in Section 18. If your appeal is denied, you may contact your state Attorney General.
